Activities of the
Department The Labour Department seeks
to maintain industrial peace in the State. The Industrial relation machinery
is always vigilant in anticipating labour problems and promptly
intervenes to resolve such problems by means of negotiations, conciliation,
arbitration & adjudications. The Department endeavors to
ensure expeditious settlement of the disputes by way of encouraging
bi-partite negotiations (Management & Workers ) and entering into
tri-partite negotiations (Management, Workers & Labour Department).
Those disputes which do not get settled are referred to the Labour
Courts/Tribunal for adjudication .The Awards of these Labour Courts/Tribunals
are accepted and published by the State Government and their implementation
is also ensured. More than 25 Labour
enactments & rules made thereunder are administered by the Department.
The enforcement of these Acts is done by the officers of Labour
Department under the charge of Labour Commissioner /Chief Inspector of
Factories. The Inspectorate staff conducts inspections from time to time
under various labour laws. Prosecutions are launched
wherever violations are noticed.
There are 9 Labour Courts
and Industrial Tribunals located at Faridabad-3 nos., Gurgaon-2 nos.,
Panipat, Rohtak, Ambala and Hissar have one Labour Court respectively. These
Courts are headed by Presiding Officers of the level of Additional District
and Sessions Judge. Their principal function is to adjudicate upon industrial
disputes referred to them by the Government besides claims of dues against
employers submitted by the workers. Efforts are being made for
implementation of minimum wages , payment of wages, enforcement of provisions
of Bonded Labour System (Abolition) Act, Child labour (Prohibition &
Regulation) Act, Inter State Migrant Act, Contract labour (regulation) Act,
ensuring Payment of Gratuity & Bonus to the workers ,compensation in
respect of injured/deceased workmen and benefit to women workers
under Maternity Benefit Act etc. Efforts are made to bring
down the number of strikes /lockouts & go-slow tactics etc. by the joint
efforts of the managements and trade unions for achieving better
productivity. The Government has also
been giving encouragement to the setting up of Works Committees under the
Industrial Disputes Act , 1947 . The Works Committees, are designed to
solve day to day problems between workers & managements in a friendly
spirit . The Minimum Wages of Industrial workers
are the highest in the country. The Govt. has revised the Minimum rates of
wages @ Rs. 3664.54/- per month and Rs. 140.94/- per day for an unskilled
worker w.e.f 1-7-2008. The department has simplified the
procedure for registration, licencing
and approval of factory building plans. Now the applications for registration and
approval of building plans are received by the concerned Asstt. Director
(IS&H) who after getting the needful correction done, tries to ensure its
submission to H.Q. within 15 days through Deputy Director (IS&H). To
facilitate the industries of NCR area, the work of Registration, Licencing
& approval of Factory Building Plan under the Factories Act, 1948 has
been entrusted to Additional Labour Commissioner, Gurgaon. Beside, all the Deputy
Labour Commissioners in the field has been notified as Registration &
Licencing Officers under the Contract Labour (Regulation & Abolition)
Act, 1970. To facilitate the Information Technology
and related industries in the State, permissions have been extended for women
to work on night shifts with mandatory mechanism for adequate protection
during working hours and for employers to take full responsibility for the
security and transportation of their women employees. I.T. and I.T Enabled services industries
have been allowed to fix their own time schedule of eight hours work and
weekly off -day by giving them exemption from the provisions of Sections 9
and 10 of the Punjab Shops & Commercial Establishments Act, 1958. This will enable them to function in
consonance with the different time zones of the countries of their clients
world wide. Government of India, Ministry of Labour
& Employment vide notification effective from 10-10-06 has prohibited the
employment of children below the age of 14 years as domestic servants,
dhabas(road-side eateries), restaurants, hotels, motels, tea-shops, resorts,
spas or other recreational centres.
For proper implementation of this notification Labour Department has
written to all the Deputy Commissioners in the State to make necessary
arrangements for rehabilitation of Child Labour who will come out from the
different occupations as a result of implementation of this
notification. Wide publicity has been
given to this notification through News Papers, Televisions and other modes
of publicity for general awareness among the masses. Various Boards /committees
i.e. State Advisory Contract Labour Board, Minimum Wages Advisory
Board, Equal Remuneration Advisory Committee etc. are constituted
under various enactments for proper implementation/regulation of labour
laws. The Government has taken
progressive steps to safeguard the workers from health hazards and
provide industrial safety at work place. To promote industrial
safety and generate awareness amongst employers, the Factory Inspectorate has
been directed to get the 'Safety Plans' prepared in respect of all chemical
and hazardous factories. In order to encourage
promotion of safety measures and create awareness in industrial units by
voluntary efforts, 'Haryana Safety Council' has been set-up which organises
'Seminars' and 'exhibitions' on safety. Every year 'State
Industrial and Safety Awards are also given to industries which have lowest
accident rate, and to industries which provide best welfare facilities. 'Labour Law Today' and
'Haryana Labour Journal' are being brought out by the Department in
collaboration with the Haryana Safety Council which disseminates
information about industrial Labour Statistics and various judgments , labour
related topics and safety to the employers, workers and others connected with
the industry. The Government of Haryana accord lot of importance to labour
welfare measures. The Government has constituted a Labour
Welfare Board under
the Labour Welfare Fund Act, 1965. In order to raise standard of living of workers and their
dependents, the Labour Welfare Board runs the following Welfare Schemes for
contributory member workers who are drawing salary upto Rs.15,000/- per month
under Section 10 of the Punjab Labour Welfare Fund Act, 1965. The benefit of Board’s Schemes
would now be available only upto labourers and their dependents, not to
managerial and supervisory staff. In brief the schemes are listed hereunder:-
The board is running following welfare schemes: 1.
Ex-gratia
to the widows/dependants of industrial workers :- This scheme was introduced in the year 1976. The main
aim of the scheme is to give financial help to the widows/dependants of
deceased workers. A lump sum amount of Rs.50, 000/-(Rs. Fifty thousand
only) is given to each widow/dependant of deceased worker. 2.
Scholarship
to the children of industrial workers :- This scheme came into
effect in the year 1980 to provide financial help to the children of
industrial workers who have secured 50% or above marks in the exam conducted
by the Boards / Universities or by schools level. Students from 9th Class to
Postgraduate level and diploma, Postgraduate diploma & degree level
courses are covered under the scheme. The girls students are provided fifty
percent extra amount comparative to boys students. 3.
Financial
help as Kanyadan to the workers on the occasion of marriage of his/her
daughter :- 4.
Financial
Help to Workers for Spectacles :- This scheme came into existence in the year 1989. Haryana
Labour Welfare Board provides an amount of Rs. 500/- or actual cost of
spectacles, which ever is less for purchase of spectacles to improve the eye
vision of workers. The worker and his/her family or dependents can avail this
scheme 5.
Excursion-cum-Study
Tour to workers :- This scheme was introduced in the year 1989.
The main aim of this scheme is to provide an opportunity to worker and their
family members to visit industrial/historical and religious places in the
country and increase their knowledge. Under this scheme the reimbursement of
fair @ 50/- paisa per kilo meter per member on the pattern (Approximately) of
Haryana Roadways is made and the reservation charges of sleeper alongwith
ordinary fair of journey made through Bhartia Railway is made. The travel can
be made by Bhartia Rail/ Roadways/ Public undertaking and Private means. 6.
Tour to
Religious Places :- This scheme came in existence on 16-11-2007. The aim
of this scheme is to provide an opportunity to industrial workers to visit
famous religious places of Haridwar, Rishikesh, Ajmer, Amritsar and Mata
Vaishno Devi Mandir. As per this scheme the worker and four members of
his/her family can visit above religious places and can stay up to four days.
The Board will provide them expenses up to Rs.50/- per member per day or Rs.
250/- per day for whole family whichever is less along with fair of both ways
as per terms and conditions defined in above scheme of “Excursion-cum-Study
Tour to workers”. One worker can also avail this
scheme. 7.
Cash help
to the workers in the event of accident in the establishments :-
This scheme came into effect in 1992. Under this scheme financial assistance
is provided to that worker who suddenly met with an accident during the duty
period and his/her application is received within a period of one year from
the date of issuance of disablement certificate by the Govt. hospital /
E.S.I. Board. The financial assistance is provided on the basis of
disablement percentage fixed by the Govt. hospital/E.S.I. Board. 8.
Mukhya
Mantri Sharam Purskar Yojna :-
This scheme was started in the year 2002 with a view to honour efficient
workers. The highly efficient, disciplined and social workers are
entitled for the Mukhya Mantri Sharam Purskar. The award will establish
identity of the awardee workers and it will also inspire other workers for
improving their functioning and it will also create atmosphere of industrial
peace in the State of Haryana. Under this scheme selected workers will be
granted certificates and cash Purskar. 9.
Labour
Welfare Centers :-
This scheme was
introduced by the Board in 1980. The aim of the scheme is to provide training
to the family members of the workers and make them self-dependent. Board is
running 10 Labour Welfare Centers at important industrial towns in the State
where free training of tailoring, embroidering, making of pickles, jams and
candles etc. is imparted by the I.T.I. trained Instructresses. 10. To provide new Bicycle to the workers :- This scheme has been introduced w.e.f. 12-2-2009.
Under this scheme the workers whose monthly income is upto Rs. 5000/- are
provided new cycle upto the cost of Rs. 2500/-from Atlas etc. companies. 11. Financial Help for computer training to the children
of the Industrial workers :-
This scheme has been launched on
12-2-2009. Most of children of labourers have left their study before or
after the completion of 10th class due to the weak financial position of
their family & involved in the another job works. Children of
the labourer who are getting short term training from the institution run by
the Hartron or any other institution affiliated to Hartron or from the
Technical Education Departent, Haryana will get the fees assistance. 12. Financial Help to the female workers/wife of male
workers on delivery (Maternity) :- This scheme has come into
effect w.e.f. 12-2-2009. Under the scheme financial assistance of Rs. 5000/-
is provided on delivery to those female workers or wife of the male workers
who does not cover under ESI scheme & upto two children only. 13. In the event of death, financial assistance to the
dependent of the worker for cremation :- This scheme has been started w.e.f. 12-2-2009. Under
this scheme Haryana Welfare Board is providing assistance of Rs.
5000/- to the widow/dependent of deceased worker in the event of
his/her death. 14. Financial help to the worker for the purchase of
school dress, books & note books etc. for girl children :- This scheme came into existence w.e.f. 12-2-2009.
Under this scheme one time financial assistance of Rs. 2000/- upto three
girls studying in 5th to 8th class is provided to the workers whose monthly
salary is upto Rs. 5000/- for the purchase of school dress, books & note
books etc. 15. Financial Assistance to the workers for the Dental
Care :- Haryana Labour Welfare
Board has launched a separate scheme w.e.f. 12-2-2009 for dental care of
workers and their family members. Under this scheme an amount of upto
Rs.1200/- is provided to the workers. 16. Financial Assistance to the workers for the purchase
of artificial limbs in the event of accident :-
This scheme is being run w.e.f. 12-2-2009. Under this scheme financial help
is provided to the worker who has not covered under ESI scheme, for the
purchase of Artificial limbs at the rates fixed by Saket Hospital, Chandi
Mandir, Panchkula. 17. Financial Assistance to the workers for the purchase
of hearing machine or hearing aids :-
Under this scheme financial help is provided to the Industrial workers for
the purchase of hearing machine or hearing aids w.e.f. 12-2-2009 who have
lost their hearing power or capacity due to accident or any other
reason. The assistance will be provided on the rates fixed by the Deaf
and Dumb Society. 18. Financial Assistance to the Handicapped workers for
the purchase of Try Cycle :- Under this scheme financial help is provided to the
industrial workers for the purchase of Try Cycle who have lost their lower
limbs in any accident.
